Because the Passaic is tidal up to the Dundee dam there may be other considerations too. I believe tidal waters are public up to the high tide mark.

Yes could be right. Funny how many riparian laws refer to 'high water mark' in case of the Passaic River, that would include most of northeast NJ. lol
