Getting back to Urban Anglers post before it got hijacked.I had the distinct pleasure of striper fishing the Hackensack in Feb with the late John Flores.If any of you knew him you would agree he was a world class angler.We caught many fish by the power plant and always practiced catch and release no matter what time of the year.Pure fun and sure cure for cabin fever!

Striped Bass Closed Seasons No person may take, attempt to take, or have in possession any striped bass from the following closed waters: Jan. 1–Feb. 28: All waters closed except the Atlantic Ocean from zero to three miles offshore. All inlets and bays are delineated from ocean waters by a Colregs Demarcation line. April 1–May 31: Delaware River and Bay and their tributaries closed from the upstream side of the Calhoun St. bridge downstream to and including the Salem River and its tributaries. Note: Non-offset circle hooks are required to reduce striped bass bycatch mortality while fishing with natural bait during the striped bass springtime spawning area closure within the Delaware River and its tributaries. Attempt to take simply means "fishing for"
It has nothing to do with what your intentions are to do with the fish itself.
A closed season of a species on a body of water or waters is a closed season period.
If you could catch and release for them, the limit would just be dropped to a 0 bag limit and state catch and release only i would think.....not say closed season.
I do know that on a closed trout stream, if you have a trout attached to your fishing line, you are technically in " posession" at that point.

I think they should actually word it differently....
They should just get rid of the "Take" wording....replace with "may not fish for or possess"

Your understanding of the wording is way off.

If someone is attempting to take he catches it, and attempts to put it somewhere or in something and is caught in the act of doing such thing.

I have 3 friends who work for NY and NJ, 2 are NY DEC and one is NJ Fish and game.
