where'd you find these videos...trout s&m website? well at least i'm sure the second one is a private area obviously.

Certainly enough solid evidence in both vids for prosecution. In the first they were fishing directly in front of the special regs sign and in the secong they obviously walked past the 'private property-no trespassing' signs to reach the stream. No leniency in this case, confiscate and fine them heavily. Just my
$.02.

I forwarded the video to NJDFGW to both Pat H. & Shawn C. Hopefully they will forward to enforcement and track down these juvenile delinquents.

!!!prosecution!!! Is this a joke or what Their freaking kids Man wow . I'm sure you guys did worst stuff when you're a kid and from my understanding if they're walking on water it's not consider a private property I think it was an awesome video with a great song take a chill pill would you . Your understanding is what most people think but is unfortunately wrong; that's not how it works in NJ and that is how Lake Solitude club, Raritan Inn, etc are able to successfully prosecute people for being on their private waters every year. There is no right to fish navigable non-tidal waters like in other states (unfortunately). Yes, it sucks.

Waters in which the tide ebbs and flows are public to the extent that the sea flows and reflows. Accordingly, the public can use such waters for boating, fishing, swimming, and all other legal activities. On the other hand, waters with no ebb and flow of the tide are private waters and generally may not be used by the public without the consent of the owners. Non-tidal waters that are navigable-in-fact may be used by the public only for navigation, but not for other purposes such as fishing.

NJDFGW is aware and looking into it.
Its spilt milk to be sure but I think giving them a good scare would set them straight.
I think all of us grew up catching trout this same way and I had more than a few causalities that swallowed the hook. Unlike most trout anglers, I was C&R from the start and have never willfully killed any wild trout. I may have even dunked a worm or two in my time into the(formerly fly only) Big Flat Brook or the many years ago(early 80's) "Natural Trout Program" stream Van Campens. To me it was no big deal.
As for trespassing, to me its unfair that somebody can own a streambed. Its a natural resource - like air or water. Landowner didn't create it, it was already there for thousands of years. Although I generally respect the signs, if I'm in the middle of the woods far from any road or home, I may walk right past the sign. Really depends on how I'm doing and odds of getting caught :p
