Last Wed. evening, I parked where I have for 24 years, off the shoulder well in the grass off the N. bound lane of Rt. 29, Rd. & fished The Del. River from there, downstream. Only catch: a 18” channel kitty foul hooked on a Rapala.

I got a $54 traffic ticket! “No parking area” established by State Hwy. Dpt. Kingwood Twp. Muncpl. Court.

When you search it on their site, the date it was posted was July 14, 2014. So, it’s something new, prompted no doubt, by the vast increase of Hot Dog Man tubers & private tubers parking on Rt. 29’s macadam shoulder.

My truck has a NJDF&W trout magnet & a Teen Angler bumper sticker,……..what the hell did the police think I was doing there? Could’ve just given me a warning.

I’m going to fight it: 24 years of parking there & No “No parking signs” posted (I took photos).

Total B.S. They treat you like a criminal for fishing.Honestly dont they have better things to do.

Local police or State Trooper? Troopers tend to give you a warning. I've parked along numerous highways - PA and NJ - and most are cool about it as long as you stay off the asphalt/road itself.

No signs? Thats total bs. Not sure how the 'no parking' laws work in NJ but in regards to private land, I think that you are guilty of trespassing on private land even if there were no posted signs.

39:4-198. Notice of ordinance, resolution or regulation by signs.

39:4-198. No ordinance, resolution or regulation enacted, passed, or adopted by local authorities nor any regulation adopted by the Commissioner of Transportation under any power given by this chapter or any supplement thereto shall be effective unless due notice thereof is given to the public by placing a sign at the places where the ordinance, resolution or regulation is effective, and by briefing its provisions on signs according to specifications contained in this chapter or as specified by the current Manual on Uniform Traffic Control Devices for streets and highways. These signs shall be so placed as to be easily read by pedestrians or operators of vehicles. Except, in the case of "No Passing" zones, in lieu of or in addition to signs, notice shall be given to the public by highway pavement markings which conform to the current Manual on Uniform Traffic Control Devices for streets and highways.

In addition to the specifications in the Manual on Uniform Traffic Control Devices, any sign erected after the effective date of this amendatory and supplementary act to notify the public that parking in a space is reserved for the handicapped shall also state the penalties set forth in paragraph c. of subsection (3) of R.S.39:4-197 which may be imposed for a violation. Signs which were erected prior to the effective date shall be modified within 12 months after the effective date to include the penalty information.

It shall not be a defense to the unauthorized use of a parking space reserved for the handicapped pursuant to R.S.39:4-138 that the penalties set forth in paragraph c. of subsection (3) of R.S.39:4-197 were not posted or were improperly posted.

Got the same one at a pull off by The river last year. Tires completely off the street and no " no parking " signs.

Funny thing is, a month before, a cop pulled up , hit the sirens, and called us over. Said nothing about the parking, checked our licenses, and told us good luck!!! What can you say, they do what they want........

They know most people can't take off work to fight a $50 ticket and take advantage of it.

It was a state cop. Court date is 9/18 @ 6 PM.

I went back to the scene of my crime & there was a pickup in the exact spot. So, I parked in front of him & took photos.

Flatcreek, thanks for the 39:4-198.,……I’ll be sure to bring that with me.

I plan to inform them that in addition to being an angler, I work for NJDF&W & fight to keep access open to all anglers. If l lose,……….I’ll bring in the big guns,…..our Asst. Director & Director.

Last evening @ Kingwood Court, female prosecutor told me “no parking to the right of the white line”. I showed her photos of my truck, off the macadam shoulder, way up on the grass, the absence of “No Parking” signs & the statute defining that “No Parking” signs must be present to incur a violation. “We will see what the judge says”, she said, “The Hot Dog Man’s activities have resulted in more parking tickets being issued to anglers.” “Great!” I responded.

Then I spied him,…you couldn’t miss him,……..the big tube steak was sitting up front surrounded by his little wiener henchmen! I caught the prosecutor’s attention & whispered to her, “Oh, I see the big criminal is here.” “Yeah”, she responded, as she rolled her eyes.

Defendants with lawyers went first, & Big Boy was @ the top of that list. The prosecutor stated, “Numerous violations here, Your Honor”:

Zoning Violation @ “The Shack” on Rt. 12 where tubes are stored. Violations pertaining to the buses (some are still identified as school buses, blockages of emergency exits, parking issues, etc.). He had to pay a few $250’s, $50’s (+ court costs) & skated on some others. His lawyer got an extension, until next month, for the zoning violation. Pay up,……just part of doing business for the HDM. While, we anglers get screwed for his actions.

A narcotics violation & the crane company involved with the Rt. 519 bridge collapse ended the high profile cases.

Alphabetical order for the rest of us,…………& I was first! Got home by 7 PM.

“Absence of signs indicating no parking,……such signs will have to be posted,…….Case Dismissed!” The judge asked me what I caught.

I’m going to check the tax maps to see who owns that area. If private, I can still park there, with the owner’s permission, of course. If it’s DOT, I can’t. In either case, I will pursue the Division’s acquisition of said area. For selfish reasons, of course,……..but also for all the anglers who park there.

I let the Judge know that part of my job is to fight for NJ angler access.

The cop that wrote the ticket should get a ticket for causing you a big pain in the butt. Glad to see it was dismissed and you took the time to stand up for whats right, more people should do that.
